Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lumae platform ("Service"), operated by Lumae ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using Lumae, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Lumae on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

You must be at least 18 years old to use the Service. By using Lumae, you represent and warrant that you meet this age requirement.

2. Service Description

Lumae is a software-as-a-service (SaaS) platform designed for fitness coaches and wellness professionals. The Service provides:

  • AI-powered content generation (social media posts, blog articles, and video scripts) tailored to your coaching voice and niche
  • Voice cloning and text-to-speech narration for generated content
  • Trend analysis based on publicly available fitness content metadata
  • Automated publishing to connected social media accounts
  • Visual content design with stock imagery and customizable templates
  • Gamification features including engagement streaks, points, and achievement badges based on your content approval activity
  • Periodic digest emails summarizing your content performance and providing tips (opt-out available in Settings)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

3. Account Registration

To use Lumae, you must create an account and provide accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Promptly notifying us of any unauthorized use of your account at support@lumae.coach

We reserve the right to suspend or terminate accounts that violate these Terms, are used for fraudulent purposes, or remain inactive for an extended period.

4. AI-Generated Content

Lumae uses artificial intelligence (powered by Anthropic Claude) to generate content based on your coaching profile, niche, tone preferences, and content pillars. By using this feature, you acknowledge and agree that:

  • Review responsibility: You are solely responsible for reviewing, editing, and approving all AI-generated content before it is published. Lumae does not guarantee the accuracy, appropriateness, or suitability of generated content.
  • No professional advice: AI-generated content does not constitute medical, fitness, dietary, or professional advice. You are responsible for ensuring your published content complies with applicable health and safety regulations.
  • AI disclosure: You are responsible for complying with any applicable laws or platform policies that require disclosure of AI-generated content. This may include, but is not limited to, the EU AI Act, FTC guidelines, and individual social media platform policies.
  • No guarantees: We do not guarantee specific engagement metrics, follower growth, revenue increases, or any particular outcome from using AI-generated content.
  • Hashtags and engagement strategies: The Service may generate suggested hashtags, caption variants, and engagement tips. These are AI-generated suggestions only. You are solely responsible for verifying that any hashtags used do not infringe trademarks, violate platform policies, or associate your brand with unintended content.
  • Video production guidance: The Service may generate shooting scripts that include camera angles, equipment suggestions, setting recommendations, and visual directions. These are creative suggestions only and do not constitute professional production, safety, or equipment advice. You are solely responsible for ensuring safe filming conditions, proper equipment use, and compliance with local regulations. Lumae is not responsible for any injury, property damage, or loss arising from following AI-generated production suggestions.

5. Content Ownership

Your content: You retain all rights to the coaching content, philosophies, content pillars, example posts, and other materials you provide to Lumae ("Your Content"). By submitting Your Content, you grant Lumae a non-exclusive, worldwide, royalty-free license to process, analyze, and use Your Content solely for the purpose of providing the Service to you (including AI content generation and voice cloning).

AI-generated output: Content generated by our AI based on your profile is licensed to you for your commercial and personal use without restriction. Lumae does not claim ownership over AI-generated content delivered to you. However, similar content may be generated for other users given the nature of AI systems.

Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by Lumae without obligation or compensation to you.

6. Draft Sharing

You may generate public sharing links for your draft content. By creating a sharing link, you acknowledge that:

  • Anyone with the link can view the shared draft content
  • You are responsible for controlling who receives sharing links
  • Comments left by external viewers on shared drafts are stored and displayed to you
  • Lumae is not responsible for unauthorized distribution of shared links by recipients
  • You may revoke any sharing link at any time
  • Shared drafts remain subject to all content ownership terms

7. Voice Cloning Consent

Lumae offers optional voice cloning and text-to-speech narration powered by ElevenLabs. By using this feature, you explicitly consent to the following:

  • Biometric data: Voice samples constitute biometric data under certain jurisdictions (including the Illinois Biometric Information Privacy Act, GDPR, LGPD, and Argentine PDPA). Your voice samples will be processed by ElevenLabs to create a digital voice model.
  • Processing: Voice samples are transmitted to and processed by ElevenLabs, a third-party service provider, subject to their terms of service and privacy policy.
  • Usage: Your voice clone will be used exclusively for generating audio narrations of your own content within the Lumae platform.
  • Deletion: You may request deletion of your voice clone at any time through your account settings or by contacting support@lumae.coach. Upon deletion request, we will remove the voice model from both Lumae and ElevenLabs systems within 30 days.
  • Withdrawal of consent: You may withdraw your consent for voice cloning at any time, which will result in the deletion of your voice model. Withdrawal does not affect the lawfulness of processing performed before withdrawal.
  • Voice model retention: Voice models will be retained only for the duration of your active account or until you request deletion, whichever comes first. Voice models will be permanently deleted within 30 days of account closure or deletion request.
  • Narration preference: You may configure how narration is applied to your posts. If you select "Let Lumae choose," our system will automatically select posts for narration using algorithmic criteria. You retain full control to add or remove narration from any post before approval.

8. Image Uploads

If you upload images to Lumae for use in your content, you represent and warrant that:

  • You own the images or have obtained all necessary rights, licenses, and permissions to use them
  • The images do not infringe upon any third party's intellectual property rights, privacy rights, or other legal rights
  • The images do not contain illegal, harmful, or objectionable content

DMCA takedown: If you believe content on Lumae infringes your copyright, you may submit a DMCA takedown notice to support@lumae.coach with: (a) identification of the copyrighted work, (b) identification of the infringing material, (c) your contact information, (d) a statement of good faith belief that the use is unauthorized, and (e) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf.

9. Social Account Connection

Lumae allows you to connect third-party social media accounts (Instagram, Facebook, TikTok, X, LinkedIn) for automated content publishing. By connecting your accounts:

  • You authorize Lumae to access and publish content to your connected accounts on your behalf, using secure OAuth tokens
  • OAuth access tokens are stored securely and encrypted at rest in our database
  • You may disconnect any social account at any time through your account settings, which will immediately revoke Lumae's access
  • Lumae is not responsible for any actions taken by the social media platforms regarding your content or account status

10. Trend Data Collection

To improve content recommendations and identify trending topics, Lumae collects publicly available fitness content metadata from social media platforms using third-party data collection services (Apify, DataForSEO, BrightData). This collection is limited to:

  • Post metadata only: platform, engagement metrics, hashtag counts, post type, and the first sentence of captions (maximum 100 characters)
  • We never store full captions, images, videos, or personally identifiable information from scraped posts
  • Collected metadata is used exclusively for aggregate trend analysis and is not linked to individual social media users

11. Third-Party Services

Lumae integrates with the following third-party services to deliver the Service. Each processor handles specific data as described below and in our Privacy Policy:

Your use of the Service is also subject to the terms and privacy policies of these third-party providers. We select processors that maintain appropriate security standards, but we are not responsible for their independent acts or omissions.

12. Subscription and Billing

Lumae offers subscription plans (Starter, Growth, and Authority) with recurring billing. By subscribing, you agree to the following:

  • Recurring charges: Subscriptions are billed on a recurring basis (monthly or annual) through Stripe. You authorize us to charge your payment method at each renewal period.
  • Free trial: If a free trial is offered, you will not be charged until the trial ends. Cancellation must occur before the trial period expires to avoid charges.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of your paid period.
  • Refund policy: For annual subscriptions cancelled within the first 14 days, a pro-rata refund will be issued for the unused portion. Monthly subscriptions are non-refundable after the billing period has begun. Refund requests should be directed to support@lumae.coach.
  • Price changes: We may change subscription prices with 30 days' notice. Price changes will apply at the start of your next billing period.
  • Add-ons: Optional add-on features (such as voice cloning) may be available for additional fees and are governed by these same billing terms.

Extra-post bundles ($6 one-time purchases)

Extra-post bundles ($6 each, including 1 social post + 1 blog post + 1 video script) are one-time purchases. Generation begins immediately upon successful payment. Per the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 Reg. 37(1)(a), by purchasing an extra-post bundle you expressly agree that performance begins immediately and you waive your 14-day right of withdrawal.

Refunds for technical failures (e.g. generation never completed, posts never appeared) are available — contact support@lumae.coach within 7 days of purchase.

Voice add-on subscription ($49/month)

The voice add-on is a recurring monthly subscription. Cancellable any time per the standard subscription terms above. UK and EU consumers who purchase a voice add-on for the first time may cancel within 14 days of initial subscription for a full refund, provided no voice clone has yet been generated. Once a voice clone is generated, the cooling-off period is waived per the same Reg. 37(1)(a) basis.

13. Data Retention and Deletion

We retain your data for as long as your account is active or as needed to provide the Service. Specific retention periods include:

  • Account data: Retained for the duration of your account plus 90 days after deletion
  • Generated content: Retained for 12 months after generation, or until account deletion, whichever is sooner
  • Voice clones: Deleted within 30 days of your deletion request or account closure
  • Payment records: Retained for 7 years as required by tax and financial regulations
  • Trend analysis data: Aggregated and anonymized data may be retained indefinitely

Requesting deletion: You may request deletion of your account and associated data by contacting support@lumae.coach or through your account settings. We will process deletion requests within 30 days, subject to any legal retention obligations.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMAE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO LUMAE IN THE 12 MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, LUMAE EXPRESSLY DISCLAIMS LIABILITY FOR ANY PHYSICAL INJURY, PROPERTY DAMAGE, OR PERSONAL HARM ARISING FROM FOLLOWING AI-GENERATED CONTENT RECOMMENDATIONS, INCLUDING BUT NOT LIMITED TO VIDEO FILMING INSTRUCTIONS, EQUIPMENT SUGGESTIONS, OR EXERCISE DEMONSTRATIONS.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Lumae and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Content you publish using the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party, including intellectual property rights
  • Any claim that content published through your account caused damage to a third party

16. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Lumae service.

UK and EU consumers: If you are a consumer in the UK or EU, you retain the benefit of any mandatory consumer protections under your local law. Nothing in these Terms limits your statutory rights as a consumer. UK consumers may also pursue complaints through the Citizens Advice Bureau or other applicable UK consumer protection bodies.

United States consumers: If you are a consumer in the United States, you retain rights under your state's consumer protection laws. Nothing in these Terms limits those rights.

Informal resolution first: We will try to resolve any dispute informally first. If you have a concern, please email support@lumae.coach before commencing any formal proceedings. We commit to responding within 14 days.

17. International Users

Lumae serves users globally. If you access the Service from outside the United States, you acknowledge that your data may be transferred to and processed in the United States, where our servers and service providers are located.

European Union / European Economic Area (GDPR)

If you are located in the EU/EEA, you have additional rights under the General Data Protection Regulation (GDPR), including:

  • Right to access, rectify, erase, restrict processing, and port your personal data
  • Right to object to processing based on legitimate interests
  • Right to withdraw consent at any time (for voice cloning and other consent-based processing)
  • Right to lodge a complaint with your local Data Protection Authority

International data transfers from the EU/EEA are conducted under Standard Contractual Clauses (SCCs) approved by the European Commission. For more information, see our Privacy Policy.

Brazil (LGPD)

If you are located in Brazil, you have rights under the Lei Geral de Proteção de Dados (LGPD), including:

  • Confirmation of the existence of processing and access to your data
  • Correction of incomplete, inaccurate, or outdated data
  • Anonymization, blocking, or deletion of unnecessary or excessive data
  • Data portability to another service provider
  • Deletion of personal data processed with your consent
  • Information about public and private entities with which your data has been shared
  • Revocation of consent

Argentina (PDPA)

If you are located in Argentina, you have rights under the Personal Data Protection Act (Ley 25.326), including:

  • Right to access your personal data free of charge
  • Right to request rectification, updating, or deletion
  • Right to object to processing of your data
  • Right to request suppression of your data from databases

18. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Provide at least 30 days' notice before the changes take effect
  • Notify you via email and/or a prominent notice within the Service
  • Update the "Last updated" date at the top of this page

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may request account deletion.
